What Is a Surety Bond & How does it work?

 

A surety bond is not a typical insurance policy. A surety Bond means you have to go through a licensed bail bondsman to pay a premium on a surety bond that the judge has set on the defendant. The Surety bond requires any individual that is 18 or older to post the bond on the individual who is incarcerated. In some cases, if the bond is set very high and the defendant seems to be a flight risk the bondsman may request collateral to assure the defendant will show up for court and not violate the bail bond conditions that that been set by the court.

What is a Cash Bond?

 

A cash bond requires the full bail amount to be paid to the court. The court will hold onto the full cash bail amount until your criminal case is concluded. At that point, the bail is returned to you. Cash bonds cannot go through a bail bondsman. Who can post a cash bond? You, your family, or your friends can post a cash bond.
